Interpretation and Definitions

Interpretation

The words contained herein of which the initial letters are capitalized have meanings as defined below, and said words shall have the same meanings regardless of whether they appear in the singular or in the plural.

For the purposes of these Terms of Use and the Legal Notices incorporated by reference into these Terms of Use:

  • "Royal House," "We," "Us," or "Our" - means the Royal House of New Sawereso-Seinuah, located in the Kukuom Traditional Area, Ahafo Region, Republic of Ghana.
  • "Website" - means the website of the Royal House, located online at www.new-sawereso.org
  • "Service" - means the Website and any services provided by or accessed through the Website, to include the pages and content of the Website, clickable links within the pages of the Website, email and form mail, access to and possession of download content such as digital photos and published documents, access to registered user sections of the Website, and any other interaction with the features of the Website.
  • "You" - means the individual accessing or using the Services, or any other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • "Terms of Use" or "Terms" - means this publication, in its entirety, and any other Legal Notice incorporated herein by reference, the whole of which forms the entire agreement between You and Us regarding the use of Our Services.
  • "Affiliate" - means an entity which controls, is controlled by, or is under common control with a party where "control" means ownership of 50% or more of the shares, equity, interest, or other securities entitled to vote for election of directors or other managing authority.

  • "Honour" - means membership in a duly constituted Royal Order, rank and title within the Royal Court, appointment to an office or official role within the Royal House, a Grant of Arms, or any other honour granted by the Royal House.
  • "Honoree" - means any individual who has accepted one or more Honour from the Royal House.
  • "Public Record" - means a record which, at the sole discretion of the Royal House, may be made available for public viewing, either in whole or in part.
  • "Communication" - means the relaying of information of any nature, to include email, messaging applications, and Third-Party Social Media services, as well as any file attachments.

Acknowledgment

These Terms of Use, including other Legal Notices presented on the Website and incorporated by reference into these Terms, set out the rights and obligations of all individuals who access or otherwise use Our Services, and form a binding agreement between You and Us. The Legal Notices which are incorporated by reference into these Terms are, viz.: Privacy Policy; Cookie Policy.

By accessing or using Our Services, You represent that You are at least 18 years of age and of legal capacity to enter into binding agreements, and that You agree to be bound by these Terms, in full.

If You are not at least 18 years of age and of legal capacity to enter into binding agreements, of if you do not agree to be bound by the Terms set forth, herein, and to comply with the same, then You are not permitted by Us to use Our Services and any further use of Our Services will constitute a trespass on Your part.

Description of Services

Under the direction and supervision of the Royal House of New Sawereso-Seinuah, Our Website serves primarily to facilitate the improvement of health, education, community infrastructure and services, and overall living conditions for residents of the Kingdom of New Sawereso-Seinuah while preserving and promoting Akan traditions and culture. We do this by collecting, organizing, and presenting information to the public in regards to the kingdom and the Royal House, by soliciting donations from the international philanthropic community, and by applying donations received towards funds and projects subsidiary to and established by the Katakyie Agyemang Duah III Nonprofit Foundation.

At the sole discretion of the ruler of the Royal House of New Sawereso-Seinuah, and for reasons known only to him, individuals may be offered various Honours or, on review and approval of petition from said individuals, granted Honours. On acceptance of Honours, the Honoree acknowledges and agrees that all information printed on the face of Letters Patent by which Honours are granted, to include the Honoree's name and geographical location, automatically become matters of permanent Public Record, as do any and all subsequent actions taken by the Royal House in regards to said Honour(s).

Honorees

If You are an Honoree of the Royal House then, notwithstanding any other part of these Terms of Use, to include those parts which are incorporated by reference, You agree as follows:

  • You agree that the Royal House is authorized to retain permanent possession of Your personal information, including all information relied upon by the Royal House in qualifying You for Honours, whereas, only the information printed on the face of the Letters Patent by which Your Honour was granted, as well as Your geographical location, shall be categorized as Public Record and, whereas, all other information retained in association with said Honour shall be treated as privileged to the use of the Royal House for security purposes, in Our defense against any litigation which may arise from activities performed under or in association with Your Honour, and to fulfill demands and requests of law enforcement and judiciary authorities.
  • You agree to be firmly bound by any Terms which may exist in Constitutions, Rules of Conduct, or any other Agreement which may be associated with the specific Honour granted.
  • You agree not to use any Honour granted to You by the Royal House to misrepresent Yourself or the Royal House, including, but not limited to, unauthorized use of titles or styles to Your name, prenominal addresses, post nominal letters, and heraldic charges and devices.
  • You agree that the Royal House may, at its discretion, publish your Public Record information on Our Website, in print, as an electronic database, or in other form now existing or yet unknown, and to distribute such information for publication by other parties, without compensation to you or any other person, and that, from time to time, the Royal House may make your information available to third-parties who may send you information through email or postal mail, or through other means of communication.

Failure to agree to and comply with the above-stated Terms may, at the sole discretion of the Royal House, result in the abatement of any and all Honours granted to You by the Royal House, as well as all rights and privileges attached to said Honours. Such abatement may include, at the discretion of the heraldic authority of the Royal House, the inverting of the individual's Arms according to heraldic tradition and the public publishing and display of the same.

Communications

All Communications with the Royal House, including the members of the Royal Court, the Royal Entourage, and Royal Appointees, are subject to classification as matters of permanent record and, at the discretion of the Royal House, are subject to further classification as matters of Public Record. When such Communications are classified as matters of Public Record, redactions may be made in said Communications in order to protect Your sensitive personal information.

In short, do not communicate anything to the Royal House which You do not want to become a part of history.

User Accounts

User Accounts enable select users to access and make use of features of the Website which are otherwise unavailable to the general public. The exact features of the Website to which said users will have access and use of varies from user to user in accordance with privileges assigned by Us, and may include, viz.: the use of email accounts on Our mail server; the ability to author, edit, or publish articles to our blog ("NSS News"); the ability to manage users and Content on the Website; the ability to make changes to Content, or to upload or delete Content; the ability to install, delete, or modify source code which makes up the Website.

At Our sole discretion, after We have requested and received accurate and complete information from select users of Our Services and said information has been reviewed and found satisfactory by Us to warrant the assignment of a user Account to the user, We may assign to the user a user Account on our Services. The assignment of a user Account, by Us, will be in the form of a username and temporary password which We convey to the user by which the user will be able to log in to the user Account.

If We assign to You a user Account, You are bound to the following Terms, agreeing as follows:

  • Upon the receipt of a username and temporary password, you agree to log in to your user Account and change the temporary password to one of your design.
  • You agree that if You change Your username, which may be viewable by others on Our Services, You will not use the name of another person or entity that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You, or a name that is generally considered to be offensive, vulgar, or obscene.

  • You agree to keep information associated with your Account current at all times.
  • You agree that, as a condition of receiving a user Account on Our Services, notwithstanding any right to privacy which You have or claim to have, including Your rights specifically addressed in our Privacy Policy, We are authorized by You to retain possession of Your personal information used in qualifying You for and assigning to You a user Account for an indefinite period of time, to be used by Us for security purposes, in Our defense against any litigation which may arise from activities performed under or in association with Your Account, and to fulfill demands and requests of law enforcement and judiciary authorities.

In addition to the above, by posting Content to the Service, You agree to grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service, and that this license includes the right for Us to make Your Content available to other users of the Service who may also use Your Content subject to these Terms, with the understanding that You retain any and all of Your rights to any Content You submit, post or display on or through the Service, and that You are responsible for protecting those rights.

Furthermore, You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

Content Restrictions

We are not responsible for the Content posted, provided, and-or otherwise communicated or transmitted by the Service's users. By assuming full responsibility and liability for any and all activities performed on the Services and-or on Our servers under your username and password, including, but not limited to, the legality, reliability, and appropriateness of Content, You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your Account, whether done so by You or any third-person using Your account.

You may not post, provide, and-or otherwise communicate or transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such restricted Content include, but are not limited to, the following:

  • Impersonating any person or entity, including members of the Royal House, members of the Royal Court, and employees or representatives of the Royal House.
  • Violating the privacy of any third-person.
  • False information and features.

We reserve the right, but not the obligation, to, in Our sole discretion, determine whether or not any Content is appropriate and complies with these Terms, and to refuse or remove Content which violates these Terms. We further reserve the right to make edits to formatting and Content, at Our discretion.

Failure to comply with the above-stated Terms will constitute a breach of these Terms and, at Our sole discretion, may result in immediate termination of your Account and the privileges which You had under said Account on Our Services.

Use At Your Own Risk

The Royal House cannot control all Content posted to our Services by users and/or third-parties, though We will act to correct or remove Content which goes against our Terms when said violation is brought to Our attention. As such, You agree to use the Service at Your own risk. You understand that by using the Service, You may be exposed to Content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Royal House be liable in any way for any such Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of your use of any Content.

Content Backups

Although regular backups of Content are performed, We do not guarantee that there will be no loss or corruption of data. Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time that a backup is performed.

We will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. You acknowledge that We assume no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

Intellectual Property

Our Intellectual Property

The Service and its Content, excluding copyrighted Content included herein under "fair use" doctrines, are and will remain the intellectual property of the Royal House and its licensors. Our Content is protected internationally by copyright and trademark laws and treaties, and may not be used individually or in connection with any product or service without the prior written consent of the Royal House.

Fair Use Notice

This Service may contain excerpts and quotes from copyrighted material the use of which has not been expressly authorized by the copyright owner. We make use of such material in efforts to advance understanding of political, economic, scientific, historic, genealogical, and other such issues for the common good and under the belief that this constitutes a fair use of such copyrighted materials. The said material in this Service is distributed without profit to those who have expressed an interest in receiving the included images and information for research and educational purposes.

This Fair Use Notice extends to Our use of media (i.e., files, digital images, etc.) classified as or purported to being in the Public Domain.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

For European Union (EU) Users

If You are a European Union consumer, you may benefit from any mandatory provisions of the law of the country in which you are resident in.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
